What Is a Personal Injury Claim?

A personal injury claim is a legal proceeding initiated by an individual who has sustained injuries, harm or losses due to the negligent or wrongful conduct of another person, organization or entity. The injured party, also known as the plaintiff, seeks compensation from the responsible party, who is referred to as the defendant.

Personal injury claims can arise from a wide range of incidents, including but not limited to, motor vehicle accidents, slip and falls, medical malpractice, product liability, workplace accidents, and dog bites. In any of these scenarios, the plaintiff must establish that the defendant had a legal duty to exercise reasonable care to prevent harm, but failed to fulfill that obligation. This failure resulted in an accident, injury or loss that caused the plaintiff’s harm.

The plaintiff must prove that the defendant’s negligent or wrongful conduct was the direct cause of their injury or loss. In other words, the plaintiff must show that their injuries were caused by the defendant’s actions and not some other factor. This requires the plaintiff to provide evidence such as medical records, witness statements, accident reports, and any other relevant information to support their claim.

Personal injury claims can be resolved through negotiations between the plaintiff and the defendant’s insurance company or legal representation. If the parties are unable to reach a settlement agreement, the case may proceed to trial, where a judge or jury will determine the outcome.
